These Terms govern your use of Flashkay, a social network for the Haitian community operated by JRICKSS Financial Services LLC. Please read them carefully.

1. Acceptance

By creating an account or using Flashkay, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the service.

2. Eligibility and age

You must be at least 13 years old to use Flashkay. The app is not directed to children under 13. In some regions, you may need consent from a parent or guardian if you are below a minimum age. By using the service, you confirm that you meet these requirements.

3. Account responsibilities and security

• You are responsible for all activity on your account.
• Keep your password private and do not share it.
• Notify us right away at support@flashkay.com if you think someone accessed your account without permission.
• Provide accurate and current information.

4. User content and license

You keep ownership of the content you post on Flashkay (posts, photos, videos, Flashes, stories, comments, messages). When you post content, you grant Flashkay a limited, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content within the service so we can operate and run it. This license ends when you delete the content or your account, except for copies that the law requires or that other people have already shared.

You agree to use Flashkay lawfully and respectfully. Prohibited uses are described in our Community Guidelines. We may remove content or suspend accounts that violate those rules.

The Flashkay name, logo, and service design are the property of JRICKSS Financial Services LLC. You may not copy or use them without permission. Respect the copyrights and trademarks of others when you post content.

8. Takedown and DMCA

If you believe content on Flashkay infringes your copyright, email us at support@flashkay.com with details about the content and your rights. We will review and may remove infringing content.

9. Suspension and termination

We may suspend or close your account if you violate these Terms or our Community Guidelines, or to protect the service and its users. You may close your account at any time in the app settings.

10. Disclaimers

Flashkay provides the service "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent the law allows. We do not guarantee the service will always be error-free or uninterrupted.

11. Limitation of liability

To the fullest extent the law allows, JRICKSS Financial Services LLC will not be liable for indirect, incidental, special, or consequential damages arising from your use of Flashkay.

12. Indemnification

You agree to protect and defend JRICKSS Financial Services LLC against claims arising from your violation of these Terms or of the rights of others.

13. Governing law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law rules.

14. Dispute resolution

We encourage you to contact us first so we can try to resolve any issue. Any remaining disputes will be brought in courts with jurisdiction in the State of New Jersey, United States, unless the law requires otherwise. (An attorney should review this if you want to add arbitration or other mechanisms.)

15. Changes

We may update these Terms from time to time. When we make important changes, we will notify you. If you keep using Flashkay after a change, that means you agree to the new Terms.
